I have just syncronize again the license in the account detail of the theme, and I tried the update, now without any problem 🙂

I am having the same problem. I have version 3.5.9.7, but i am not able ti update at 3.5.9.9 because of this error:
An error occurred while updating Ashe Pro: Download failed. Forbidden
